1) Shaikh Ibn Bazz Ka Fatwa:

Kya Bossa Se Wazu Toot Jata
Hai?

Jawaab:

Shaikh Ibn Bazz Kehtey Hain: Hazrat Aisha (Raz) se riwayat
hai ke: “Nabi kareem ny baaz azwaj mutahraat ko bossa diya aur phir wazu kiye bagair namaz ke liye tashreef le gaye.” (Abu Dawud Hd.no: 178,179, Jame At Trimizi Hd.no: 86 Wa Ahmad 6 :2, 10, 207)

Is hadess me iss hukam ka bayan
hai ke kya Aurat ko chone aur bossa denese wazu totta hai ya nahi, ulama (Rah) ka iss masleh main ikhtelaf hai, baaz ne kaha hai ke isse har haal me wazu toot jata hai aur baaz ne kaha ke agr shehwat ke sath Aurat ko chowa to wazu toot jayega warna nahi tootega aur baaz ny kaha hai ke isse mutalqan wazu nahi tootta aur inme se yahi qoul rajeh hai yani mard jab apni biwi ko bossa de ya is ke hath ko choway ya issy apny sath lagaye aur is sy issy na inzal ho aur na woh muhadas (be wazu) ho toh isse mard ka wazu toty ga na orat ka, Kyuke asal yh hai k wazu apni halat per berqarar rahy ga illa yeh ke kisi daleel sy maloom ho ke wazu toot toot gaya hai aur kitab Allah aur sunnat Rasool Allah (Sallallahu Alaihi Wasalam) se aisi koi daleel sabit nahi jisse maloom ho ke Aurat ko choone se wazu toot jata hai lehaza Aurat ko chone se khuwah bagair kisi cheez ke hail howay aur khuwah shehwat ke sath chony sy aur bousa dainy aur sath lagany se bhi wazu nahi tootta..

2) Shaikh Ibn Usaiymin Ka Fatwa

Sawaal:

Dermiyan mai kisi cheez k hail
huway bagiar ager koi admi kisi ajnabi orat ko hath lagata hai to is ke liye shariyet ka kya hukam hai?
kya isse wazu toot jayega ya nahi?
Naiz yeh bataye ke ajnabi orat se kya maqsood hai?

Jawaab:

Ahel-e-ilm k sahi tareen qoul ke mutabiq orat ko hath lagany se wazu nahi totta kyun kr hadis se sabit hai ke: “Nabi kareem (S.A.W) ne azwaj mutehrat mese kisi ko bossa diya, phir namaz parhi aur wazu na kiya.”

Lekin Aurat ke liye yeh jaiz nahi
hai ke woh kisi gair mehram ke sath musahifa kare aur na mard ke liye yeh jaiz hai ke woh kisi gair mehram Aurat ke sath musahifa kare.

Nabi Kareem (S.A.W) ka irshad grami hai ke: “main Aurton se musahafa nahi karta.”
Hazrat Aisha R.A. sy ravayat hai ke: “Nabi kareem Aurton se sirf hum kalam hokar baiyet liya karte the aur kabhi bhi kisi Aurat k hath ko appka hath nahi laga tha.”

Aur Allah ka farman hai ke: “Yaqeenan tumhare liye Rasool Allah ki zaat me behtreen aur umdah namona maujood hai.”

Aurton ka gair mehram mardo se
aur mardo ka gair mehram Aurto sy musahifa sab ke liye fitna ka sabab hai aur kamil tareen islami shariyet ai hi isliye hai ke in tamam zarai ko band kerde jo in amoor tak pohanchaty hain’ jinhen Allah ny haram qarar diya hai. isse yeh bhi maloom ho gaya ke ajnabi orat sy murad woh orat
hai k jiske aur mard ke darmiyan nasb ya kisi dosre mubah sabab ke bais koi aisa rishta na ho jiski wajah se woh iske liye haram ho maslan: Maa, Behan, phophi wagaira ya kisi sharai sabab ki waja se haram hai.. Maslan razat-o-musahiret wagaira toh aisi Aurtein ajnabi nahi hain..
